Texas Traffic Ticket Dismissal

The State of Texas requires all drivers with a traffic ticket to request permission to take a defensive driving course by the appearance date on your ticket. You may request permission in person or by mail. You'll have 90 days to complete the online course and receive your certificate of completion to have your traffic ticket dismissed from your driving record.

In Texas, you must submit the following when requesting permission to take a defensive driving course:

  • Completed and notarized signature copy on the Affidavit form.
  • Proof you have a valid non-commercial Texas driver's license.
  • Your court administrative fee
  • Copy of your Insurance policy

Texas law requires the following for a student to qualify:

  • You must NOT possess a Commercial Drivers License (CDL)
  • You must admit to guilt or sign a statement that you do not contest the citation
  • If you were cited with driving 25 or more miles per hour above the posted speed limit you will not be permitted to dismiss your ticket

You will qualify to dismiss your traffic ticket if you have not taken a defensive driving course in the last 12 months. In Texas, you are allowed take a TEA-approved defensive driving course 1 time every 12 months to dismiss your traffic ticket.
